Purposes of Processing – Your data will be processed in order to;
- provide services under contract to you and others;
- comply with regulatory and other legal obligations; and
- protect Capulet Solicitors against potential claims.
Legal Bases – Your personal data will be processed by Capulet Solicitors on the bases of legal obligation, contractual necessity and legitimate interest.
Personal Data Held – As a minimum, Capulet Solicitors is required to positively identify its clients. This also includes positively identifying a director in the case of a corporate client. In addition, Capulet Solicitors holds whatever information is provided to it by its clients and others. This will rarely include special category data.
Failure to Provide Data – If you fail to provide Capulet Solicitors with the data required you will not receive services.
Data Sources – Capulet Solicitors obtains all personal data from its clients and those who have indicated that they have an interest in Capulet Solicitors’ services. Capulet Solicitors also collects some data from publicly available sources (e.g. Land Registry, Companies House etc).
Recipients – Any data provided by a client is treated as confidential to that client and will only be shared with others in so far as this is necessary in order to provide the services contracted for by the client, to comply with regulatory and other legal obligations and to protect Capulet Solicitors against a potential claim.
Third Countries and Safeguards – To the best of our knowledge, data stored with Capulet Solicitors are not transferred to any other country and is used just in the UK.
Retention Period – For litigation matters, we retain your file for six years. For purchases we retain your file for 12 years whilst for sales, we retain your file for 6 years. Thereafter files will be securely destroyed.
Data Subject’s Rights – Where relevant, you have the right (subject to client confidentiality) to:
- withdraw consent to the processing of your data (please contact Margaret Ilori. The Principal Solicitor by email or letter to the firm’s address);
- complain to a supervisory authority regarding the processing of your data (https://ico.org.uk/); and
- obtain a copy of the data held on you and to correction of any errors in that data(please contact Margaret Ilori, the Principal Solicitor by email or letter to the firm’s address).
No fee will be requested in line with legislation but we reserve our right to charge a fee or refuse to comply in the event of a manifestly unfounded, excessive or repetitive request. Any request will be responded to within 28 days.
Automated Decision Making – None. You also have the right to ask to delete your data after the Retention Period referred to above.
